SEC and CFTC Release Final Rule Related to Private Fund Reporting

The SEC and Commodity Futures Trading Corporation (CFTC) have jointly released a
final rule that amends Form PF — that is, “the confidential
reporting form for certain SEC-registered investment advisers to private funds,
including those that also are registered with the CFTC as a commodity pool operator
. . . or commodity trading adviser.” The final rule is intended to “enhance the
Financial Stability Oversight Council’s . . . ability to monitor systemic risk as
well as bolster the SEC’s regulatory oversight of private fund advisers and investor
protection efforts.”
