SEC Releases Proposed Rule Related to Crypto Assets

The SEC has released a proposed rule, Regulation Crypto Assets,
that would “create a tailored offering regime for certain investment contracts
involving crypto assets.” The proposed rule comes on the heels of the SEC’s March
2026 interpretive guidance that
clarifies the application of the securities laws to certain crypto assets and
crypto-related transactions. Along with the interpretive guidance, the proposal is
part of the Commission’s broader effort to foster innovation and remove barriers to
capital formation within the crypto asset markets while protecting investors and
providing them with the information they need to make investment decisions.
